A lady from Pennsylvania has filed a proposed revised complaint, naming Tracy Morgan, Jimmy Fallon, and “Saturday Night Live” creator Lorne Michaels as defendants, claiming they were complicit in Horatio Sanz’s alleged wrongdoing.
According to court documents from 2021, the lady alleged that Horatio Sanz , a former “SNL” cast member, began grooming her when she was 14 and sexually abused her when she was 17. According to CNN, Jane Doe claimed that Sanz sexually harassed her at and after “SNL” parties by “kissing her, pinching her breasts, caressing her buttocks, and digitally probing her genitals aggressively and without Plaintiff’s consent.”

Horatio Sanz Has Refuted The Charges
In the proposed revised complaint filed on Tuesday, the lady alleges that Fallon was “as aware of Sanz’s online grooming attempts as he was of his in-person behaviour.” The documents also allege that NBC, Morgan, Fallon, and Michaels “facilitated” Sanz’s sexual assault and battery by “creating the physical environment in which Sanz raped Doe” and “repeatedly disregarding and even promoting Doe’s underage attendance at SNL after-parties and after-after-parties.
The new suggested complaint is a result of the recently modified Gender Motivated Violence Act in New York City (GMVA). Beginning next March, the GMVA contains a one-year “look back window” that permits accusers to sue their alleged abusers and those accused of facilitating that conduct. A breach of the act is defined as “a crime of violence committed because of gender or on the basis of gender, and at least in part due to an animus based on the victim’s gender.
In a brief in support of her proposed amendment, she explains, “While Doe’s claims are currently barred by the statute of limitations, on March 1, 2023 (and until March 1, 2024), Plaintiff’s claims will not be barred by the statute of limitations, and she will be able to bring her GMVA claims against all proposed defendants due to the look-back window in the amended GMVA.
In the interest of judicial economy, she begs the court to approve her request to amend her complaint to add the GMVA allegations. A spokesman for NBC told CNN in an email, “NBC expects to repeat its move to dismiss regardless of Jane Doe’s shifting narratives.” NBC Universal filed a motion to dismiss in April, arguing that “the Complaint fails to set forth facts showing that in 2002 NBCU was aware of Sanz’s alleged predatory behaviour or of any propensity he had for sexual assault” and that “Plaintiff does not allege that she or anyone else informed NBCU in 2002 of the facts she alleges in her Complaint today.
NBCU also stated that she did not sufficiently demonstrate a “causal relationship between NBCU’s alleged breach of duty and Sanz’s alleged sexual assault during a coworker’s off-premises party.” In April, Sanz filed a response to the initial lawsuit in which he denied the charges. His filing also asserts many defenses to Doe’s claims, including that her claims were not filed in a timely manner and that Jane Doe consented to the alleged actions to the extent that he engaged in any of the alleged activity.
CNN has contacted spokespeople for “Saturday Night Live,” Fallon, Morgan, Michaels, and Sanz for comment. In the current proposed case, Jane Doe claims she texted Horatio Sanz in 2019 and he stated he “felt bad” about his actions. “However, he evaded assuming complete blame by stating, “…I allowed us to get closer and closer together.” I was a feeble man.” the suit alleged. The lawsuit seeks reimbursement for legal bills in addition to compensatory and punitive damages.
